Screw the Law, i’ll do what I want

[ this is a follow-up to yesterday’s gun control post on the 1-gun-a-month law in Jersey City NJ ]

This is the leftist, “reality base community” mindset in a nutshell. Push through an illegal law, watch it fail in court. Appeal the decision. Lose the appeal. Appeal the appeal all the way up to the state supreme court. And if that should fail? Well, leftist elitists know better than the rest of us mindless slobs, so they’ll just do as they damn please, screw the law and screw the courts.

The New Jersey Supreme Court heard oral arguments Monday in the legal battle over a Jersey City ordinance limiting handgun purchases.

``There’s just too many guns out there,’’ said Jersey City Mayor Jerramiah Healy. ``There’s no legitimate reason on earth why anyone needs to buy five handguns a month.’’

Attorney Frank Pisano, who represented the Association of New Jersey Rifle and Pistol Clubs, told the court that collectors and investors often need to buy many handguns simultaneously when a valuable gun collection becomes available. And he said it’s unreasonable to suggest people providing criminals with illegal handguns would be willing to undergo a lengthy permit review by law enforcement.

``There’s no rational basis for this ordinance,’’ Pisano said. ``It targets the tool and not the criminal.’’

``It’s 100 percent politics,’’ Frank Caso, owner of Jersey City’s only operating gun store said of the ordinance. ``It doesn’t make any sense to punish legal gun owners for the actions of criminals.’’

Jersey City attorney Bill Matsikoudis told the seven members of the state’s highest court that Caso’s Gun-O-Rama Inc. sold weapons used in 87 gun crimes from 1989-1997 and made 166 multiple gun sales from 1995 to 2000. He blamed gun industry lobbyists for blocking passage of a state bill limiting handgun purchases to one per month. It’s stalled in the New Jersey Senate after being approved by the Assembly.

Healy said he’ll issue an executive order directing his city’s police not to approve more than one handgun permit a month for each applicant if the Supreme Court rules against the ordinance, which never has been implemented. It was defeated in state court Dec. 13, 2006 and lost a subsequent appeal in September 2008.

When the NJ Supreme Court rules that Healy’s law is invalid, I suggest that a goodly number of Jersey City residents apply for bulk pistol purchase permits on a regular basis, just to check that he hasn’t made such an executive order, or even such a verbal directive. NJ gives you a 90 day window on each permit. Call it 3 months. So apply for 6 permits at a time, (they’re only $2 each), which is 2 pistols per month. And then get your lawyers ready.

Not that very many people ever read this far down, but this blog was the creation of Allan Kelly and his friend Vilmar. Vilmar moved on to his own blog some time ago, and Allan ran this place alone until his sudden and unexpected death partway through 2006. We all miss him. A lot.
