Alabama Fights Back Against SCOTUS

This has been brewing for weeks now since the Supreme Court’s decision in Kelo vs. New London that gave government the right to snatch land for private development. Several states are already preparing legislation to block this heinous crime against landowners everywhere. Alabama became one of the first to sign into law legislation to prohibit any land-snatching schemes this week when the state legislature unanimously voted to approve a bill to protect homeowners. Governor Bob Riley signed the bill into law yesterday ....

MONTGOMERY - Governor Bob Riley today signed a law that gives Alabamians the strongest private property rights in the nation. In a ceremony in the State Capitol’s historic Old House Chamber, the Governor called the U.S. Supreme Court’s recent ruling on property rights “misguided” and a “threat to all property owners.”

“In response, a property rights revolt is sweeping the nation and Alabama is leading it,” Governor Riley said, noting that press reports say Alabama is the first state in the nation to pass a new law in response to the high court’s June 23 decision in Kelo vs. City of New London. In that case, the Supreme Court ruled 5-4 that local governments can seize homes for private development. At least eight other states had already passed laws before the court’s ruling that forbid the use of eminent domain for economic development unless it is to eliminate blight.

“Alabamians can rest assured that their homes, their farms, their businesses and other private property are safe from being seized by government for a shopping center or a factory, an office building or new residential development. With this new landmark law on the books, Alabamians will have the strongest property protections in America,” said Governor Riley. The bill was included in Governor Riley’s call for the recently concluded special session and it was approved by an overwhelming vote in the House and Senate. The new law prohibits the state or local governments from condemning private property in non-blighted areas for the purpose of retail, commercial, industrial, office or residential development.

“What our new law does is restore the level of protection that existed prior to the Supreme Court’s ruling in June,” Governor Riley said. “That ruling is a reminder of the awesome power that activist judges have, and unfortunately use, to rewrite our Constitution. What Alabama is doing with this new law I just signed counteracts that ruling.”

Need. More. Air.

I have a great deal of respect for astronauts.  I would jump at the chance to go up in space.  They are smart folks, especially the ones who have gone on multiple missions.  But they really need to keep their pie-hole shut when they try and pontificate on subjects not in their area of expertise.

HOUSTON (Reuters) - Commander Eileen Collins said astronauts on shuttle Discovery had seen widespread environmental destruction on Earth and warned on Thursday that greater care was needed to protect natural resources.

“The atmosphere almost looks like an eggshell on an egg, it’s so very thin,” she said. ”We know that we don’t have much air, we need to protect what we have.”

We know we don’t have much air?  Good grief.

• Jay, over at StopTheACLU.com is on a roll today with the weekly blogburst. Today’s topic is the ACLU and their position on the Second Amendment. Personally, I think the ACLU’s position on gun rights should be six feet under.


• We’ve got reinforcements just joining in the fight against liberal idiocy. The site is conservative and run by a babe. What else could she call it but ConservaBabes. She’s located in the largest Muslim stronghold in North America, “Near New Fallujah”, as she calls it (Detroit). Today she is serving up a downright nice fisking of the New York Times. My kinda gal! Give ‘em hell, kiddo!


• Macker is up to his usual tricks .. and concerns. Today, he is worried about the Vatican and a possible attack by MOOS-LIMS. Relax, Mack! If the ragheads set off so much as a firecracker in St. Peters, the complete extinction of the Arab races will begin within seconds. Trust me.


• Phil, over at TuffBeingRight hasn’t posted in several days. I believe it’s because of the photo at the top of his last post on July 29. He and all visitors to TBR are probably suffering from blindness. Warning: not for the squeemish or faint-hearted!

Most Ridiculous Item Of The Day

How stupid can people get? After reading the story below, I had to re-adjust my stupidity meter. There needs to be a “stupid index” to rate these clowns. If so, the two people in this news story would rank somewhere off the far bottom of the scale. If you’re inclined to ask “what were they thinking”, don’t bother. My impression is neither the mother or the daughter were thinking at all. Just sit back and enjoy the entertainment ....

Daughter Caught Making Meth To Bail Out Mother:
Mother Was Police Officer Facing Pot Charges

LINCOLN, Ill. (AP)—There is a bizarre twist in the case of a former Lincoln, Illinois police officer facing marijuana possession charges. Her 24-year-old daughter has been charged with trying to make methamphetamine to raise bail for her mother.

Authorities say Brianna Strohl’s mother, Diana Short, asked her daughter to collect materials to make methamphetamine because Short needed to post another $7,500 to get out of jail. Authorities were tipped onto the plot by Logan County Jail inmates.

Short, who had been a Lincoln police officer until her arrest, previously was accused of growing marijuana plants in her basement.

Strohl and Short both were charged yesterday with several felony counts related to making methamphetamine. Short now needs $25,000 to get out of jail, and Strohl is being held in lieu of ten-thousand dollars bond.

NEW YORK—A broadly beaming U.S. Ambassador John R. Bolton presented his credentials yesterday to U.N. Secretary-General Kofi Annan, losing no time in getting started on his new job after a painful and extended confirmation process. Even before yesterday’s brief ceremony, which included several moments of small talk about Mr. Annan’s recent shoulder surgery, Mr. Bolton had spent several hours at the U.S. Mission in New York getting acquainted with members of a severely depleted staff.

Television and still cameras recorded the Bolton-Annan meeting, at which tense body language belied a courteous verbal exchange. Mr. Annan’s face was carefully composed into a stiff smile while Mr. Bolton’s hand remained clenched in his suit pocket. “I should give you this, I suppose,” Mr. Bolton said, handing over a large manila envelope containing a formal letter of introduction signed by President Bush.

Mr. Bolton, famous for his candor, was uncharacteristically silent as he entered and left the U.N. Secretariat, a building he once noted could be reduced by 10 stories without anyone noticing. In an interview hours later, Mr. Annan said he was glad the new ambassador had arrived and urged him repeatedly to work well with others. “We are in the middle of major reform of the United Nations and it’s a topic that has seized all the members of the organization, and I hope that he will join in these discussions and work with me and the other ambassadors to reform the United Nations,” Mr. Annan said in his 38th-floor offices. “Obviously, being the permanent representative of the United States with the support of the president, he will have an important voice,” Mr. Annan said. “But as I have indicated, it will be an important voice among many and I trust that he will work with the others to help us achieve our goals.”

Stupid Criminal Of The Day

Altogether, this doesn’t seem like that bad an idea and a way to make money .. except for the fact that it’s illegal ....

BERLIN (Reuters) - A court in Germany convicted a man for fraud after he racked up huge phone bills phoning a sex hotline from work and split the proceeds with a woman working at the service, authorities said Wednesday.

“He wasn’t calling for the stimulation,” said a spokesman for the court in the western city of Duesseldorf.

The court handed the 38-year-old an eight-month suspended jail sentence for the ruse which he cooked up with the hotline worker while working for a local medical insurer.

German media said the man had made more than 160 calls within half a year, at a cost to his company of almost 16,000 euros ($19,700).

On This Day In History

On August 3, 1492 an Italian navigator named Cristoforo Colombo (Christopher Columbus) set sail from Spain in search of Cathay and the Indies by a Western route. On the evening of August 3, Columbus left from Palos with three ships, the Santa Maria, Niña and Pinta. The ships were property of Juan de la Cosa and the Pinzón brothers (Martin and Vicente Yáñez), but the monarchs forced the Palos inhabitants to contribute to the expedition. He first sailed to the Canary Islands, fortunately owned by Castile, where he reprovisioned and made repairs, and on September 6 started the five week voyage across the ocean.

A legend is that the crew grew so homesick and fearful that they threatened to hurl Columbus overboard and sail back to Spain. Although the actual situation is unclear, most likely the sailors’ resentments merely amounted to complaints or suggestions. After 29 days out of sight of land, on 7 October 1492 as recorded in the ship’s log, the crew spotted shore birds flying west and changed direction to make their landfall. Columbus called the island he reached San Salvador. The Native Americans he encountered, the Taíno or Arawak, were peaceful and friendly. He wrote with such awe of the friendly innocence and beauty of these Indians that he inadvertently created the enduring myth of the Noble Savage. “These people have no religious beliefs, nor are they idolaters. They are very gentle and do not know what evil is; nor do they kill others, nor steal; and they are without weapons.”. No blood was shed on this first voyage; he believed conversion to Christianity would be achieved through love, not force.

Columbus Sets Sail

From the Spanish port of Palos, Italian explorer Christopher Columbus sets sail in command of three ships--the Santa Marýa, the Pinta, and the Niýa--on a journey to find a western sea route to China, India, and the fabled gold and spice islands of Asia.

On October 12, the expedition sighted land, probably Watling Island in the Bahamas, and went ashore the same day, claiming it for Spain. Later that month, Columbus sighted Cuba, which he thought was mainland China, and in December the expedition landed on Hispaniola, which Columbus thought might be Japan. He established a small colony there with 39 of his men. The explorer returned to Spain with gold, spices, and “Indian” captives in March 1493 and was received with the highest honors by the Spanish court. He was the first European to explore the Americas since the Vikings set up colonies in Greenland and Newfoundland in the 10th century.

During his lifetime, Columbus led a total of four expeditions to the New World, discovering various Caribbean islands, the Gulf of Mexico, and the South and Central American mainland, but never accomplished his original goal--a western ocean route to the great cities of Asia. Columbus died in Spain in 1506 without realizing the great scope of what he did achieve: He had discovered for Europe the New World, whose riches over the next century would help make Spain the wealthiest and most powerful nation on earth.

Europe, in the year 1492 had reached a critical point. The Muslim capital of Granada was finally captured by the Spanish and the last Muslim stronghold in Europe was destroyed. The Muslim advance into Europe that had begun six hundred years earlier was finally stopped and driven back. Spain was finally united under Ferdinand and Isabella. The Reformation was in progress across the continent and the entire economic structure was altered forever with millions of deaths from the bubonic plague during the previous century. Feudalism was dead and the merchant class was growing. Things were about to get pretty exciting ....

The State Of Europe

Christian Europe, long allowed safe passage to India and China (sources of valued trade goods such as silk and spices) under the hegemony of the Mongol Empire (Pax Mongolica, or “Mongol peace"), was now, after the fragmentation of that empire, under a complete economic blockade by Muslim states. In response to Muslim hegemony on land, Portugal sought an eastward sea route to the Indies, and promoted the establishment of trading posts and later colonies along the coast of Africa. Columbus had another idea. By the 1480s, he had developed a plan to travel to the Indies (then roughly meaning all of south and east Asia) by sailing west across the Ocean Sea (the Atlantic Ocean) instead.

It is sometimes claimed that the reason Columbus had a hard time receiving support for this plan was that Europeans believed that the Earth was flat. This myth can be traced to Washington Irving’s novel The Life and Voyages of Christopher Columbus (1828).

The fact that the Earth is round was evident to most people of Columbus’s time, especially other sailors and navigators (Eratosthenes (276-194 BC) had in fact accurately calculated the circumference of the Earth). The problem was that the experts did not agree with his estimates of the distance to the Indies. Most scholars accepted Ptolemy’s claim that the terrestrial landmass (for Europeans of the time, Eurasia and Africa) occupied 180 degrees of the terrestrial sphere, leaving 180 degrees of water. In fact, it occupies about 120 degrees, leaving 60 degrees unaccounted for at that time.

Columbus accepted the calculations of Pierre d’Ailly, that the land-mass occupied 225 degrees, leaving only 135 degrees of water. Moreover, Columbus believed that one degree actually covered less space on the earth’s surface than commonly believed. Finally, Columbus read maps as if the distances were calculated in Roman miles (1524 meters or 5,000 feet) rather than nautical miles (1853.99 meters or 6,082.66 feet at the equator). The true circumference of the earth is about 40,000 km (24,900 statute miles of 5,280 feet each), whereas the circumference of Columbus’s earth was the equivalent of at most 19,000 modern statue miles (or 30,600 km). Columbus calculated that the distance from the Canary Islands to Japan was 2,400 nautical miles (about 4,444 km).

In fact, the distance is about 10,600 nautical miles (19,600 km), and most European sailors and navigators concluded that the Indies were too far away to make his plan worth considering. They were right and Columbus was wrong – but, ultimately in his case, like in that of so many successful individuals, initiative and enterpreneurship ended up being more important than factual accuracy.

Columbus went on to make four voyages to the New World and helped inaugurate the Spanish conquest of Central and South America. The search for gold was on and the Spanish were determined to get all of it. Of course, the Spanish eventually were robbed of all that gold by other European countries and what wasn’t stolen, the Spanish threw away in vain attempts to expand their empire in Europe. As for Columbus, his life after the exploration of America was also a tragedy ....

The Final Years

While Columbus had always given the conversion of non-believers as one reason for his explorations, he grew increasingly religious in his later years. He claimed to hear divine voices, lobbied for a new crusade to capture Jerusalem, often wore Franciscan habit, and described his explorations to the “paradise” as part of God’s plan which would soon result in the Last Judgement and the end of the world.

In his later years Columbus demanded that the Spanish Crown give him 10% of all profits made in the new lands, pursuant to earlier agreements. Because he had been relieved of his duties as governor, the crown felt not bound by these contracts and his demands were rejected. His family later sued for part of the profits from trade with America, but ultimately lost some fifty years later.

On May 20, 1506, Columbus died in Valladolid, fairly wealthy due to the gold his men had accumulated in Hispaniola. He was still convinced that his journeys had been along the East Coast of Asia.

Russia Boots ABC Out Of The Country

The liberal media in this country never ceases to amaze me. TIME magazine goes to Iraq and interviews “insurgents” and publishes stories about how they make roadside bombs. NEWSWEEK interviews Palestinian suicide bombers. And the broadcast media is even worse. They all try to make the damned murdering terrorists look like peaceful, righteous humans who can do no wrong. The Palestinians are “oppressed”. The Chechen rebels are simply trying to drive out their Russian “overlords”. The Iraqi insurgents simply want the US to leave their country. The Muslim bombers in Britain simply want to have their voices heard. The US media have taken the freedom of the press concept way too far as ABC found out yesterday ....

MOSCOW, Russia (Reuters)—Moscow is barring journalists from U.S. television channel ABC from working in Russia after the channel broadcast an interview with Chechen rebel leader Shamil Basayev, the Foreign Ministry said on Tuesday. Accreditations for ABC’s reporters would not be renewed and, in the meantime, they would be banned from talking to Russian officials, it said.

Free speech advocates have repeatedly criticized President Vladimir Putin’s government for restricting the Russian press, but this appeared to be the first action against a major Western media organization.

“ABC is now unwelcome to contact any Russian state organizations or bodies,” a Foreign Ministry statement said. It said broadcasting the Basayev interview “was a clear case of helping to propagandize terrorism” and accreditations for ABC workers would “not be renewed”.

There was no immediate U.S. reaction, but one official, who asked not to be named, said banning ABC journalists “would obviously be a concern”. ABC was not immediately available for comment. The U.S.-based Committee to Protect Journalists said: “This action reflects the Kremlin’s growing intolerance of any kind of criticism, especially in regard to its actions in Chechnya.”

CPJ Executive Director Ann Cooper’s statement said Russia was “clearly trying to intimidate foreign journalists into censoring their news reporting on the war in Chechnya. We call on the (foreign) ministry to reverse its decision immediately.” Russia was outraged by the interview with Basayev, who is its most wanted man and organized the bloodiest attacks of the 10-year Chechen war. Moscow summoned the U.S. envoy to complain after it was broadcast last week.

The asshat “journalists” at ABC need to be kicked out of America too, as far as I’m concerned. I’m dead set against restricting the freedom of the press to cover the news but where do you draw the line? Did Edward R. Murrow go to Berlin to get Hitler’s side of things? Hell no! The media have a responsibility that comes with the freedom to publish anything they want. They are currently ignoring that responsibility and what they are doing is a criminal act of propaganda .... for the bad guys.

Somehow or the other, we have to find a solution to this problem. A press gone wild with righteous indignation, publishing stories with a decided preference for the murderers, criminals, bombers and terrorists is outside the pale and it is about time somebody reined them in. Gently though. We don’t want to limit their ability to keep us informed. We just want to make them act rationally, responsibly and be accountable. After all, that is what they expect of the governments they report on.

If the liberal American media doesn’t get its act together real soon, they may find themselves replaced .. by the blogosphere, and writers like myself who use a little common sense in what we report on. Yes, we’re an opinionated bunch but you know that. Here, you have a choice - you can go elsewhere and get another blogger’s opinion that is the complete opposite of mine. You also have instant feedback to question my sources and even my opinions. You can even argue among yourselves over what is being reported.

Perhaps that is where the mainstream media is going wrong - they are so used to just telling us what they want and distancing themselves from their readers. They just drop their opinions on us and walk away. I can’t do that. The comments and forums here are open and there are thousands of people out there right now at their keyboards just waiting to voice their opinion. That is freedom of speech, which is much more important than freedom of the press.

Maybe, just maybe, the framers of the Constitution had the blogosphere in mind when they wrote the First Amendment, which gives us the right to gather together, say what we want and complain to our government ....

Are You Who You Say You Are?

Unlike the internet and the blogosphere, your local Department of Motor Vehicles expects you from now on to be able to prove you are who you say you are. A few years ago, liberal states like California and New York were handing out drivers licenses to anyone who walked into their offices, even illegal aliens. This has now come to a screeching halt with the REAL ID Act, even if you live in a small town in Kansas where everybody knows everybody ....

ELLSWORTH, Kan. (AP)—Federal law will make county treasurer Paula Schneider do something that would be plain rude on the streets of this little town: treat friends as strangers. Never mind that she knows practically everyone who walks into her office and wants a driver’s license. Under the REAL ID Act meant to deter terrorists, Schneider will have to make neighbors prove who they are. Homeland security is taking a toll on the homespun way of doing things at government offices like hers.

The law will require people to come up with more papers attesting to their identity and citizenship status before they get a driver’s license. States say this will drive up costs and lengthen lines at motor vehicle offices. Schneider anticipates headaches and hard feelings. “We’ll have unhappy people,” she said. “They’ll say, ‘You know me.’”

People in bigger places are accustomed to impersonal take-a-number processing and Soviet bread-line waits at their driver’s license office. Not so in Ellsworth, a central Kansas town of 2,100 residents and some 800 inmates at the big state prison on the outskirts. Government business is done with a breezy informality.

“Right now if somebody comes in who lost their license, we’ll write down their name and their birthday and go back there and see what we can find on the computer,” said Schneider, gesturing behind the counter of her office in the old stone courthouse. A high-school yearbook may suffice to establish someone’s identity. But because neighbors are serving neighbors, even that much is usually unnecessary now. Under the changes, though, people will have to prove themselves several times over.

All I can say is, it’s about time. I have my birth certificate in my desk drawer and I carry my passport with me at all times, just in case. I know who I am and can prove it, which I usually have to do several times a week. But will this stop terrorists or illegal aliens? Of course not. The jerk from Guatemala who crashed into me last December and totalled my vehicle was drunk, had no license, no insurance, no verifiable address and apparently no place of employment. He was in the country illegally, working for strictly cash and had used same to buy a piece of crap car to go out and get drunk in. He has since disappeared and the police and my insurance company can’t find him. The place to stop these asshats is at the border, not at the DMV. That’s kinda like shutting the barn door after all the horses have escaped or in my case .... the jackass from Guatemala.

Not that very many people ever read this far down, but this blog was the creation of Allan Kelly and his friend Vilmar. Vilmar moved on to his own blog some time ago, and Allan ran this place alone until his sudden and unexpected death partway through 2006. We all miss him. A lot. Even though he is gone this site will always still be more than a little bit his. We who are left to carry on the BMEWS tradition owe him a great debt of gratitude, and we hope to be able to pay that back by following his last advice to us all:

2. Stay involved with government on every level and don't let those bastards get away with a thing
3. Use every legal means to defend yourself in the event of real internal trouble, and, most importantly:
