I hope so - it seems that as of now - it would be decided with at least gravity and a somewhat sound grounding in the Constitution. Besides even if somehow she gets approval - she won’t sit until the First Monday in October. These cases would be either re-submitted or already settled.
The one I would have liked to have seen is the Berg case - simply because President Transparent (NOT) would have had to in court defended as to why he would not produce a raised seal birth certificate. Even the explanation alone would have been interesting.
But there are still rumblings on Sotomayor’s ‘abortion stance’ and if enough people talk up her Catholic upbringing and a pro-life ruling or two - she will be dead in the water faster than you can Latina.
This is something I hope to see come before the court this October, whether Sotomayor is confirmed or not.
So far as I know, she must recuse herself if the USSC is deciding any case she’s already made a ruling on.
Better now, than later, when BarryO has a chance to appoint more justices with racial ‘wisdom’ rather than knowledge of constitutional law.
