  1. Happy Thanksgiving Drew (and to everyone else at BMEWS.) I hope everyone and their families had an excellent feast.

    Our annual hosting of American Thanksgiving in Canada had to be reduced to our household only.  We’d normally invite many guests over to partake.  I’ve come down with a terrible chest cold (possibly the actual flu) and I didn’t want to risk spreading it to friends.  Mrs. Tiger was disappointed (she enjoys entertaining), but was understanding of the situation.

    The British Columbia Supreme Court has ruled:  B.C. Supreme Court rules polygamy ban is constitutional, but flawed

    The actual ruling is here, with a jump direction to the Conclusion portion:

    This came out pretty much how I expected.  The Court acknowledged that the section of the Canadian Criminal Code that prohibits polygamy could (and does) infringe people’s Freedom of Religion, but then concludes that the infringement is justified when balanced against the harm that would be done to women and children were the law to be struck down.  (Many of the Rights and Freedoms in the Charter are not absolute.)

    The Court also made suggestions to Parliament on how the law could be made better.  Frankly, if the law wasn’t bad enough to be struck down, then I say “good enough” and let the law carry on as-is, but I guess if Parliament wants to revisit this particular hot potato, they can.

    The decision can be appealed to the Supreme Court of Canada.  I’m not sure if the FLDS Church is going to attempt that or not, we’ll have to wait and see.
