Legislate In Haste, Repent At Leisure

NEW YORK (WABC)—It appears someone forgot to exempt police officers from the ban of ammunition clips with more than 7 bullets in New York State’s new gun control law.

It’s a big oversight that apparently happened in the haste by the Cuomo Administration to get a tough package of gun-control measures signed into law.

On Tuesday, Governor Andrew Cuomo signed the sweeping gun measure, the nation’s toughest. It includes a ban on the possession of high-capacity magazines.

Specifically, magazines with more than 7 rounds will be illegal under the new law.

The problem as the statute is currently written does NOT exempt law enforcement officers.

The NYPD, the State Police and virtually every law enforcement agency in the state carry 9-milli-meter guns, which have a 15-round capacity.

Unless an exemption is added by the time the law takes effect in March, police would technically be in violation of the new gun measure.

Exemption? No. NO WAY. Dagnabbit, cops are not more special than anyone else. If New Yorkers can’t have more than 7 rounds to defend themselves, then neither can New York police. Nor FBI agents serving in the state. Nor TSA. Nor CIA. Nor IRS. Nor EPA. No serving members of the military either. Even moreso, they should not be allowed to have more than 7 rounds on their person. No double mags in the belt buckle. No bandoleers or tactical vests full of ammo. 7 shots in the gun or in their pockets, total.

EQUAL PROTECTION UNDER THE LAW. FOR EVERYONE.

PERIOD.

A spokesman for the Governor’s office called us to say, “We are still working out some details of the law and the exemption will be included.”

The fuck you will, dirtbag. The bill is signed. It is LAW. You can not just go in and add a paragraph later because “Oopsie, we forgot!” You can NOT “still be working out some of the details”. The bill is passed and is signed AS IS. It is LAW.

Any changes to that law will have to be brought up in the Legislature, sent to committee, entered into the schedule, debated in the houses, and then voted on, the same as any other law. Now try selling it to the public and their representatives in Albany that the cops and the feds have a screaming need for machine guns, high capacity “ammo clips”, pistol grips on their rifles, and handguns with an empty weight of more than 52 ounces. Show me that their need is greater than mine or yours; that these people are more important citizens than the rest of us. ESPECIALLY retired cops. Meanwhile, I’ll be busy finding a nice tall tree with some sturdy branches.

Not that very many people ever read this far down, but this blog was the creation of Allan Kelly and his friend Vilmar. Vilmar moved on to his own blog some time ago, and Allan ran this place alone until his sudden and unexpected death partway through 2006. We all miss him. A lot.
