Court: FCC has no power to regulate Net neutrality

The Federal Communications Commission does not have the legal authority to slap Net neutrality regulations on Internet providers, a federal appeals court ruled Tuesday.

A three-judge panel in Washington, D.C. unanimously tossed out the FCC’s August 2008 cease and desist order against Comcast, which had taken measures to slow BitTorrent transfers before voluntarily ending them earlier that year.

Because the FCC “has failed to tie its assertion” of regulatory authority to an actual law enacted by Congress, the agency does not have the power to regulate an Internet provider’s network management practices, wrote Judge David Tatel of the U.S. Court of Appeals for the D.C. Circuit.

Tuesday’s decision could doom one of the signature initiatives of FCC Chairman Julius Genachowski, a Democrat. Last October, Genachowski announced plans to begin drafting a formal set of Net neutrality rules--even though Congress has not given the agency permission to do so.

President Obama’s Federal Communications Commission (FCC) has fittingly chosen the darkest day in 372 years [ not only is today the Winter Solstice, the shortest day of the year, we also had a full lunar eclipse very early this morning (last night) ] to impose potentially devastating regulations on the up-to-now free market Internet.

As the moon was eclipsed earlier today, Congress and the American people will be eclipsed by this regulatory coup d’état—orchestrated by the White House—that will substitute the judgment of three Democrats at the FCC for the legitimate democratic process.

Starting today, the Internet will be regulated, despite the fact that network neutrality regulations have almost no support in Congress, where Rep. Ed Markey’s legislation, which aimed to do by legitimate means what the FCC is now doing surreptitiously, has just 27 co-sponsors.

Starting today, the Internet will be regulated, despite the fact that on November 2 that American people let out a collective scream against big government and intrusive regulations, and the further fact that all 95 candidates who signed the Progressive Change Campaign Committee’s pledge to promote network neutrality regulation lost. That’s 0 for 95.

Starting today, the Internet will be regulated despite the fact the D.C. Circuit Court of Appeals ruled unanimously in “Comcast v. FCC” that such regulations have no legitimate basis in law.

THIS IS TOTALITARIANISM IN ACTION. What are YOU going to do about it?

The solution is clear. Congress must make it a top priority to overturn these regulations early in 2011, preferably with a Congressional Review Act Resolution of Disapproval that can avoid filibuster and cleanly invalidate the order. The resolution can be forced onto the Senate floor with as few as 30 senators signing a discharge petition.

The rules would prohibit phone and cable companies from abusing their control over broadband connections to discriminate against rival content or services, such as Internet phone calls or online video, or play favorites with Web traffic.

Lawmakers in both parties have been arguing for months that Congress, not the Obama administration, should take the lead role in deciding whether and how much to police the web. But despite a brief backing-off earlier in the year, the FCC pushed ahead with its new regulatory plan.

President Obama said in a statement that the plan “will help preserve the free and open nature of the Internet while encouraging innovation, protecting consumer choice, and defending free speech.”

If they don’t fix it, they wont be able to:

Study why the fix caused problems

Hire more people to manage the fix

Hire people to fix the mistakes fixing the fix

Mount a study to plan for a better fix

Hire people to blame those who did the original fix

Train new people for the new tech that develops since then

Move everyone to a new project they can fix

...you know, like everything else they muck up....
