I’m of the opinion that this is going to be used as an excuse to further erode the sovereignty of the states. I’ve posted on another thread about this. I don’t want the President or anyone else to be able act in place of local or state authority without the permission of the state authority. There are provisions made for exceptional circumstances as mentioned in the article. That should be enough. We don’t need to lower the bar to federal action any farther.
Posse Comitatus is one of the things that keep us from looking like China, Cuba, Russia or anyplace else the army can be turned against the populace. I like that idea.
When considering things like this, don’t look to the present President. Look to the future and fill in your worst nightmare of a President. Even for those who consider the present President their worst nightmare. It could be a lot worse. I don’t want to enable any future dictators.
Bear in mind that the Romans had their own version of posse comitatus which forbade any military commander (Consul) from crossing the Rubicon River (many miles north of Rome) without surrendering his military command and it was also forbidden for Rome’s legions to be brought to and camped out in the city of Rome.
January 11, 49 BC - Julius Caesar crossed the Rubicon and marched his legions on Rome. The Senate fled and civil war ensued, eventually resulting in Caesar’s asassination and the death of the Republic when Augustus, Caesar’s nephew, was declared Emperor. Four hundred years later, Rome was gone.
Now, imagine Hillary Clinton, Ted Kennedy or John Kerry is President, another disaster occurs and martial law declared, posse comitatus suspended. Who ya gonna call when the military is ordered by the Commander In Chief to shoot to kill any suspicios characters, dissenting voices are rounded up and imprisoned, bloggers are shut down and arrested, the media is censored and Congress is sent home for the duration?
