    Yeah, the hypocrisy is sickening. Probably best to get rid of the page/intern system altoghether.

    In the mean time, maybe we can cut through some “moral outrage” and other BS:

    Let’s be perfectly clear: what is the legal age of consent in Washington DC?
    I think I’m reading this right: the age of consent in DC is 16. Any lawyers here who can tell me better?

    Next let’s look at what actually happened. Did these two have a gay affair? Not that I’ve heard ... so charges of 1st and 2nd degree child abuse are out. PERHAPS Enticement might stick, but most likely not; these two never actually got together did they? Can we make a case for Sexual Harrassment? That’s a possibility; Foley was in a power position over this kid. If the kid doesn’t want to press charges, is there even a case then?

    Ok, so what do we really have? Possibly flirtacious electronic communications. When did they occur? Was the recipient under the age of consent (16) at the time? If so, then Foley could be found guilty of violating some kind of lewdness law ... if these IMs/emails still exist and can be proven to be unaltered. If they don’t, then its just another “he said/she said” case and you’ll never get a conviction.

    If Foley did this, his behavior was wrong. If it can be proven he did this then he should face some sort of punishment. To me, right now it looks like this is another tempest in a teapot; yet another “gotcha” right before an election.

  4. I admit to having almost zero interest in this story, but if what I picked up in the comments over at Daily Pundit is correct, then it seems that Foley didn’t actually hit on this guy until after he was no longer a page ... so work related sexual harrassment would then be out too.

    If so, what then do the Dems actually have on this guy? Legally, nothing. I think it may have been a mistake for him to resign; he should have fought it. Ethically? Well, this is an icky situation, what with F being more than twice the youngsters age. But the wail of moral outrage coming from the kill-the-fetus/lower-the-age-of-consent/its-just-sex-and-everybody-lies-about-that/do-her-with-a-cigar crowd takes us right back to blatant hypocrisy. Which is just as repugnant as the rest of this situation.
