  1. OCM - Aren’t there two different charges from the same event? First assault, attempted murder, then later murder.  No statute of limitations on murder. There might be a tenuous connection between death by infection and a shooting 32 years earlier, but that’s for medical experts and a jury to determine.

  4. The original verdict being overturned would remove the double jeopardy, I believe. I dunno if the plea on reduced charges would suffice to keep the double jeopardy out of play. Looking at it from the point that they took the plea I’d say that there wasn’t enough to convict him in 1978 so I’d suggest that there’d be less evidence/testimony to convict him now.

    On one hand it is a shitty thing to do but on the other hand serving three years for paralyzing some random stranger doesn’t seem like enough punishment to me either.
