  1. Article 1, Sec. 6

    “No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office.”

    I’m no constitutional lawyer, but that seems to disqualify him from holding both offices at least.

  2. Thank goodness for that at least. “holding”, but not “winning” or “running for”.

    But if he should win both, then he has to give one away. Obviously it will be the Senate seat. Which means the citizens of Delaware get a Senator appointed for them by their governor Ruth Ann Minner (D). You betcha she won’t appoint an (R). [granted this is how it always was prior to the 17th amendment, but that was a long time ago]

    I still think he’s trying to ride a camel through the eye of a needle. It just ain’t right.

  5. Fixy Headline please. Biden (D-MBNA) isn’t running for State Senator, but UNITED States Senator. If McCain wins, Crappy Nappy (Governor Janet Napolitano) HAS to appoint a Republican to his seat. Our State Law says so.

  7. Keep in mind that election campaigns never used to be so long.  The last few election cycles have stretched the campaign seasons out to the point where there is no break.  Obama started running for President almost two years ago.
