The individual must be a uniformed soldier, obeying a specific identified chain of command and with a declared military action (someone out there please correct me if I mis-state this). Otherwise, the individual is an illegal combatant (otherwise known as a spy) and is subject to immediate execution.

Geneva Convention? Whaaaat?!? I do not believe that the U.S. (in its war on terror) has been or is at war with any nation-state (besides Iraq), so why apply Geneva to these S.O.B.s? al-Qaeda never signed the Geneva Accords, so why do the “wisemen” of SCOTUS feel we need to play by those rules with these folks? The British Redcoat analogy is appliciable to this situation.
When will the clueless Left and the self-centered, power-hungry politicans in our country (and abroad) realize that we are in a war of ideologies here. Extremist Islams do not care about the labels of “liberal”, “conservative”, “Republican”, “Democrat”. I’m certain that just as many of each of these people were killed during the 9/11 and 7/7 attacks. They didn’t stop to give due consideration to who they were killing. Yet bleeding-heart Liberals in this country are more than happy look out for the rights of these scumbags so that nothing challenges the “shiny happy” worldview that they persist in trying to maintain. These folks need to realize that a group of people have declared war on us and want us all dead.
I would have thought that the wholesale slaughter of THOUSANDS of Americans during the 9/11 attacks would have polarized our nation around the single unifying thought that we all need to do whatever it takes to stop terrorism. I was wrong. I shudder to think what it will take before people wake up, see the world for what it is and finally decide to put aside their overblown notions of self-importance in order to put the common good as the top priority for once.
Playing by “rules” that al-Qaeda have on intention of ever following will be seen a sign of weakness by its members. They will not “respect” us for following the rules and will, like any good soldier in a war, take advantage of that weakness. There will come a day soon when they realize they no longer need suicide bombers. All they have to do is to kill as many Americans as they can before they are finally cornered and then throw up their hands in surrender and say, “I want my attorney!”

I think Bush may be right this time. See, the terrorists have taken to bombing and terrorizing their own people. Shiites shooting up Sunni neighborhoods, Sunnis bombing Shiite mosques. This can only turn the general Shiite/Sunni public against terrorism.
What I don’t like is SCOTUS telling POTUS how to conduct war. Not the business of SCOTUS to make policy on war. I’d have said ‘The Supreme Court has ruled, now let them enforce it.’ (I forget which President actually said that. I think it was either Andrew Jackson or Teddy Roosevelt.)

I have to agree with most here - these leftists are going to force battlefield soldiers to just shoot without trying to take prisoners with all their bellyaching about the ‘poor’ prisoners.
