It’s already been documented that these guys will use any means of communication they can to continue violent jihad, why make it any easier? Even if we monitor every word, it’s not that hard to work a code into a conversation. Lots of unimportant guys were caught, checked out and released. These guys were special cases. If these guys were important enough to be hauled to Gitmo for special attention, then they should have disappeared from the world on the day we got our hands on them.They should be permanently noted as MIA.
Now I’ve got to ask a question I’ve asked before: Since the penalty for civilians bearing arms in a war zone, wearing civilian clothes and using those weapons against military force has been summary execution (sometimes after “vigorous” interrogation), why does anyone even think these guys have any rights at all? Sometimes there have been exceptions, but that has always been determined by the troops on the spot. In other wars, I don’t know of “enemy combatants” being granted anything except the right to die, what makes these guys special?

An “unlawful enemy combatant” is defined by the US as someone who “has engaged in hostilities or who has purposefully and materially supported hostilities against the United States or its co-belligerents who is not a lawful enemy combatant (including a person who is part of the Taliban, al Qaeda, or associated forces)”.
According to the Geneva Conventions, a lawful enemy combatant is someone who fights in regular armed forces or in a militia that wears a “fixed distinctive sign”, carries arms openly and abides by the rules of war.

These people are as stated above “Unlawful Enemy Combatants”.
That means they fight under no flag or Insignia and do not obey the rules of War.
So what State do we negotiate with for their release?

I gotta go with Jeff on this one. These POS’s are not POW’s, they are war criminals. They have certain rights, namely the right to a trial by a tribunal. after that, shoot em. Lets not cave to the left by according them a status they have failed to earn.
I’m actually okay with this. Sure, they can try to work a code into their conversation. Likewise we can try to break it. Whether they embed a code or not, we can try to find out where that call went, and try to track information flow from there.
This could actually work in our favor, both as subtle psychological torture and as intel gathering.
