  1. In a decision hailed as a rare legal victory for common sense, he ruled that European judgments should never be allowed to trump laws passed at Westminster.

    Bravo! Hope it stands up.

    I see a parallel between that and what is happening here the States.

    ObamaCare is being challenged not just in the courts, but through nullification. Some states are trying to pass laws fining and/or imprisoning Federal agents attempting to enforce ObamaCare.

    Another state (Montana? One of the Dakotas?) is doing the same with respect to firearms law. Firearms produced, sold, and owned in the state are not subject to the Commerce Clause. It’s really quite simple; the Feds can only regulate interstate commerce, not intrastate commerce. I think that bill, which would jail and fine BATF agents, has passed one house. The governor has signaled that he would sign it.

    It’s about time. The 9th and 10th Amendments are still part of the Constitution. Congress can only do what is specified in Article One, Section 8.

    I might add that under Article One, Section 8 Congress is allowed to ‘coin’ money, not print it by fiat.

    I hope that British/English common law prevails. You seem to be in the same position with the EU as the States are with the Federal government. The argument is also similar: The Federal government was created by the several States, not the other way around. Ditto for the EU. The EU was created by the several nations.
