Addicts who steal may escape jail. makes about as much sense as health and safety regs.

Last Updated: 11:37PM BST 11/05/2008Burglars and thieves could escape jail if they commit their crimes because of addiction to drink, drugs or gambling, under proposed sentencing guidelines.
The recommendation is contained in a consultation on how judges should punish those convicted of thefts and burglaries.The document, from the Sentencing Guidelines Council, details how serious offences should be assessed and when judges should make allowances for mitigating circumstances.
The guidelines say: “Many offenders convicted of acquisitive crimes are motivated by an addiction, often to drugs or gambling. This does not mitigate the seriousness of the offence but an offender’s dependency may properly influence the type of sentence.”
They suggest that rather than a prison term, “it may sometimes be appropriate to impose a drug rehabilitation requirement or an alcohol treatment requirement as part of a community order or a suspended sentence order in an attempt to break the cycle of addiction and offending, even if an immediate custodial sentence would otherwise be warranted”.
The document states that if “an offence has been committed in desperation or need arising from particular hardship”, that may keep someone out of jail in exceptional circumstances.
The Conservatives suggested that judges were being pressed to keep offenders out of jail to ease over-crowding in cells.
Nick Herbert, the shadow justice secretary, said: “People will be uncomfortable with the idea that professional thieves who prey on the vulnerable may only receive community service.”
Patrick Mercer, a Tory member of the Commons home affairs committee, said: “Rehabilitation can go on in prison. I don’t see why these are mitigating factors.”
The deadline for consultation is the end of next week.
