Presidential Memorandum/Executive Order - Obama Style

This one is a little complex, so please bear with me.

There is speculation about when Obama is going to implement amnesty for illegal aliens with an executive order and what that order might look like.  Here is a real example of how Obama uses executive orders to change the law.

It seems sort of odd that our President would protect a contractor from the consequences of endangering the American public, but it’s real.  My first thought was to wonder why something like this is necessary.  I’d also like to know who is going to benefit, why did Obama prepare and sign this memorandum?

SUBJECT:  Authorizing the Exercise of Authority Under Public Law 85-804

By the authority vested in me as President by the Constitution and the laws of the United States of America, I hereby direct the following:

The Administrator of the United States Agency for International Development (USAID) is authorized to exercise authority under Public Law 85-804, as amended (50 U.S.C. 1431 et seq.), to the same extent and subject to the same conditions and limitations as the head of an executive department or agency listed in section 21 of Executive Order 10789 of November 14, 1958, as amended, with respect to contracts performed in Africa in support of USAID’s response to the Ebola outbreak in Africa where the contractor, its employees, or subcontractors will have significant exposure to Ebola.  This authority may be exercised solely for the purpose of holding harmless and indemnifying contractors with respect to claims, losses, or damage arising out of or resulting from exposure, in the course of performance of the contracts, to Ebola.

The USAID is exercising functions in connection with the national defense in the course of complying with its humanitarian mandate, and there is a relevant state of national emergency that authorizes use of Public Law 85-804.  I deem that the authorization provided in this memorandum and actions taken pursuant to that authorization would facilitate the national defense.

This memorandum is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

You are hereby authorized and directed to publish this memorandum in the Federal Register.

BARACK OBAMA

Obama cites Public Law 85-804 as his authority.  That law was written in 1958.  It seems to give authority for expediting certain small contracts, streamlining or eliminating the bidding process and expediting payments.  It’s fairly short, only about a page and a half. 

Two items about Public Law 85-804 got my attention:  First, there is a requirement that a state of national emergency exist for the law to have effect.  I assume somewhere is the specific emergency Obama has in mind, but it’s not cited.  It underscores how little Obama needs to invoke a national emergency.

What I don’t find is anything preventing remedies in civil court.  Where does it permit anyone to prevent anyone else from suing for damages in court?  Doesn’t that infringe on our Constitutional Rights?

My brain is a little buggy today, so I might be missing something important.  I’d like you guys to look this over and see if you can figure out how Public Law 85-804 gives Obama the authority for redefine the law in civil courts.

Anyone wishing to vent is encouraged to do so.  Just don’t violate the law on terrorist threats.  OK?

a national food policy?

Shades of Stalin!

How we produce and consume food has a bigger impact on Americans’ well-being than any other human activity. The food industry is the largest sector of our economy; food touches everything from our health to the environment, climate change, economic inequality and the federal budget. Yet we have no food policy — no plan or agreed-upon principles — for managing American agriculture or the food system as a whole.

That must change.

I’d have to disagree. Why we allow people who think like this to continue drawing breath? THAT must change. Leave us alone!

If you like what ObamaCare is doing for health insurance, you will love what a federal program to control what we eat does for food, as it takes into account “the environment, climate change, economic inequality” et cetera ad nauseam.

A federal stranglehold on how food is produced, distributed, and consumed will allegedly guarantee the following:

● All Americans have access to healthful food;
● Farm policies are designed to support our public health and environmental objectives;
● Our food supply is free of toxic bacteria, chemicals and drugs;
● Production and marketing of our food are done transparently;
● The food industry pays a fair wage to those it employs;
● Food marketing sets children up for healthful lives by instilling in them a habit of eating real food;
● Animals are treated with compassion and attention to their well-being;
● The food system’s carbon footprint is reduced, and the amount of carbon sequestered on farmland is increased;
● The food system is sufficiently resilient to withstand the effects of climate change.

In this time of illegal immigration I think first we have to define ‘All Americans’. And what is this ‘our public health and evironmental objectives’? Define ‘toxic’? I don’t see people keeling over dead-right-there (DRT) from bad stuff in the food. As for the production of our food, it is already transparent. Anybody can take a tour of a slaughter house or processing center. I just bought 1/4 of a cow. 170# of various cuts, hamburger, tongue, liver, etc. I’ve taken two tours of the farm. I’ve been behind the scenes at the local butcher’s. I’ve been to pig farms, chicken farms. It’s already transparent. All you have to do is request a tour and go. As for the marketing? By definition that’s transparent. You see it on TV, you hear it on radio.

Food industry already pays a fair wage.

“…a habit of eating real food.” I’m certain I’ve never eaten imaginary food. Last time I saw that trick was in the movie ‘Hook’.

Animals are already treated with compassion.

Carbon footprint? I still can’t get anyone to show me a ‘carbon footprint.’

Climate has always changed. The ‘food system’ — whatever that means — has always survived.

This has been tried before, and it worked wonderfully, according to Walter Duranty of the New York Times. Joseph Stalin used it suppress resistance to collectivization in the Ukraine. This was called the Holodomor.

Only those with a vested interest in the status quo would argue against creating public policies with these goals.

If you like going to the supermarket and seeing the shelves covered in food that you want to eat at a price you can afford, you have a vested interest in the status quo. If you want to stand in line for a bowl of gluten-free government gruel, don’t bother putting up any resistance to endlessly encroaching liberalism.

I’m not a fan of pesticides, but neither are farmers big fans of crop damage. Hmm, if only there were a flying creature that could help out with this problem. Wait, there is! Bats save the United States alone an estimated $3.7 billion a year by reducing crop damage and pesticide use.

‘Hidden death penalty:’ Pope Francis calls for end to life sentences

Pope Francis has renewed the Catholic Church’s call to eliminate the death penalty, going one step further to blast life sentences and urge countries to prohibit the practice of transferring prisoners to torture centers.
Speaking to the International Association of Penal Law, Pope Francis called on countries to improve prison conditions, but also condemned the use of extraordinary rendition, in which individuals from one country are detained and transferred to another. Oftentimes, detainees are held in secret prisons and could be subjected to torture.
This practice was infamously employed by the CIA in the wake of the September 11 World Trade Center attacks, with the help of key allies. Francis also criticized those who helped facilitate the practice.
“These abuses will only stop if the international community firmly commits to recognizing … the principle of placing human dignity above all else,” he said.
The Pope added that people should continue the fight to end capital punishment.

Well dear reader …. the bastard DID get himself a new name and an apt. for old age folks paid for of course by the same folks who have paid for him all these years past.
I guess so much for a life sentence actually meaning life.

I can find nothing at all wrong with justice administering revenge along with penalty. The two belong together. But no.  The killer of three in this case is out and free.

Pope dope should be pleased however, that at long last, the stone cold bragging killer is a free man.

BTW ... least I forget.  His victims should anyone care, are still dead.

In Florida I read, another miserable excuse for a human who in 1992 murdered his wife and then raped his 10 year old stepdaughter for 20 minutes before shooting her dead, finally after all this time got his.  He was put (humanely) to death by the state.
Why does it have to be humanely?  Why does society have to accommodate the lowest forms of life to appease the left?
1992 to 2014.  Critics of the death penalty say it does not deter crime.  Well hell no.
Not the way it’s carried out it won’t. Never will either.

But the Pope dear has all this love you see, and because he believes the bull shit, he insists that the world accept his final word on the subject.

Maybe he should schedule a trip to Syria or Libya and try reasoning with the muslims who are happy to kill each other just for the hell of it.

NYT Still Going Deep On Obama

Suppressing The Gag Reflex

I see a lot of this out there. CNN and MSNBC are experts at it as well. Gak. But in almost all cases, if you can spot the phony argument, you can dismiss it as sycophantic nonsense. If you don’t want to do that, I suggest inhaling before reading each paragraph, and having tissues nearby just in case.

WASHINGTON — President Obama emerged from last week’s midterm election rejected by voters, hobbled politically and doomed to a final two years in office suffering from early lame-duck syndrome. That, at least, was the consensus in both parties. No one seems to have told Mr. Obama.

In the 10 days since “we got beat,” as he put it, by Republicans who captured the Senate and bolstered control over the House, Mr. Obama has flexed his muscles on immigration, climate change and the Internet, demonstrating that he still aspires to enact sweeping policies that could help define his legacy.

Ooh, dat man’s so big and strong!

But aides said Mr. Obama has concluded that he cannot let opposition from the other party stop him from advancing his priorities, and in his postelection comments, Mr. Obama predicted he would take actions that Republicans would not like. While White House advisers interpreted the election results as a mandate to work across the aisle, they said that cannot simply be a prescription for more gridlock where the president does nothing without Republican approval.

blah blah blah, but our brave leader marches on. Because he, and he alone, knows what’s best for the entire nation, and who cares what those little citizens clamber for.

Here comes the fantasy comparison argument* -

Although they do not present it this way, in some ways Mr. Obama and his aides are taking a page from President George W. Bush’s playbook after his own “thumping” in his final midterm elections. Instead of pulling out of the deteriorating war in Iraq, as Democrats interpreted Mr. Bush’s election mandate, he sent more troops. Democrats like Mr. Obama, then a senator, accused the president of defying the voters. In the end, the reinforcements and a strategy change helped turn around the war.

So they bent the truth a bit with the 2006 “thumping” - while the GOP did lose 6 seats, the bottom line was a 49-49-2 tie, and a tie doesn’t send a “mandate” at all, it’s just typical grumpy American voters - and Bush put the Surge into play. Which was what his generals wanted, and what it took to win the war. Senator Obama couldn’t see that, nor could Senator Clinton ("A willing suspension of disbelief” as she called the generals liars to their faces), yet it was just what the doctor ordered. So: no mandate, Obama was dead wrong, was there even a strategy change?, Bush won ... this is the same thing as 2014’s massive mandate, wherein Obama is still dead wrong, Alinsky and Cloward-Piven wrote his strategy, he does his damnedest to lose everything, from the next Olympic host city to entire swaths of nations in the Middle East. So stick with him, because our guy sure knows what he’s doing.

Well, that’s the problem. We know what he’s doing too. And the message from the people, loud and clear, is STOP.

Time for another Crusade?

Israel: Only Safe Place For Christians In Middle East

The Jewish state is the only safe place where the Christians of the Holy Land live in safety,” Fr. Gabriel Naddaf, a Greek Orthodox priest from Israel, told the United Nations Human Rights Council (UNHRC) in September.

“The earth of the Middle East is soaked with the blood of Christians being killed daily,” Naddaf said in testimony released Wednesday by the non-governmental organization, UN Watch.

The priest pointed to the grim statistic that the Christian population of the Middle East has gone from 20 percent at the start of the 20th century to only around 4 percent today.

“If we look at the Middle East, Mr. President, we realize there’s only one safe place where Christians are not persecuted. One place where they are protected, enjoying freedom of worship and expression, living in peace and not subjected to killing and genocide,” Naddaf said.

“It is Israel, the country I live in. The Jewish state is the only safe place where the Christians of the Holy Land live in safety.”

“Do you know that over the past years some 100,000 Christians have been killed annually?” the priest asked UNHRC members in Geneva. “And why? Not for a crime they’ve committed, but only for believing in Christ.”

Naddaf talked about the dwindling number of Christians in Iraq and Syria, saying that “in Iraq alone, more than 77 percent of the Christians have fled during the year 2000, in addition to thousands killed and expelled.”

Although “some 2 million Christians lived in Syria, but today, they are less than 250,000,” he pointed out.

“Christians in the Middle East are marginalized; their rights denied, their property stolen, their honor violated, their men killed, and their children displaced,” the priest concluded.

“Where will they go? Who will defend them? And who will guard their property?” he asked.

The situation is just as dire in Sudan and other parts of central eastern Africa. Egypt is rife with wanton violence and murder against the Copts. And every single attack is done in the name of Allah. This is the real face of islam: murder.

Russia plans to send long-range bombers to patrol the Gulf of Mexico and the Caribbean, the nation’s defense minister said, amid escalating tensions with the West over Ukraine.

The patrols would bring the flights close to the United States’ territorial waters. In September, the U.S. intercepted six Russian planes, including fighter jets, near airspace off Alaska, officials said.

The plan to send the long-range bombers is in response to a growing international resentment against Russia, defense minister Sergey Shoigu said Wednesday.

“Under these conditions, the formation of full-fledged and self-sufficient forces on the Crimean peninsula is a priority task.”

How’s that for inverse logic? The world is upset with Russia because of it’s behavior in Crimea, therefore it is justified sending more forces to Crimea to combat this. Riiiight.

“In the current situation we have to maintain military presence in the western Atlantic and eastern Pacific, as well as the Caribbean and the Gulf of Mexico,” he said. “Due to that, as part of the drills, Russian long-range bombers will conduct flights along Russian borders and over the Arctic Ocean.”

Even more of the same. The world is pissed at them for acting like belligerent thugs, therefore they are justified in acting like belligerent thugs ALL OVER THE WORLD ... in self defense. Riiiight.

Nuclear capable Bombers from the Soviet re-Union over the Cayman Islands, over Cuba? Off the coast of New Orleans, hovering over the oil tankers coming in and out? I guess this is Chairmain Obama being “more flexible after the election”, just as he promised his ex-Marxist red pals.

This is a true first in human achievement, and a deservedly proud moment for ESA, the European Space Agency.

But behind all the hoopla, there is an actual woman—a physical body where the forces of fame and wealth converge. Who isn’t at least a tad curious about the flesh that carries the myth?

Your mythic curiosity is now satisfied, back, side, and full frontal, in explicit oiled up detail. And it’s so much more than her wondrous aboriginal ability to balance a champagne glass (or a small VW, probably) on the flesh shelf that is the top of her magnum derriere.

This is what matters in the real world. Everyone saw Kim naked today. Only a few even bothered to look at the comet probe thing, and before about a week ago when it started getting back in the science news, probably not one in ten million people remembered it from the launch a decade ago. But you all know that Kim and her [mustn’t say it, mustn’t say it, mustn’t say it] husband Kanye West had the intellectual foresight to name their child North. North West. (and if life really imitates art, North will have a son and name him North as well. North, by North West. Then that North can have a son and name him Cary Grant.)

Obama Sells Out Tibet

Correct me if I’m wrong, but isn’t Free Tibet supposed to be a big Liberal/Progressive cause?

The headline is the money quote, but I like the first three paragraphs of the Daily Mail article.

President Barack Obama reaffirmed on Wednesday the United States’ position that Tibet is ‘part of the People’s Republic of China.’

‘We are not in favor of independence,’ Obama said during a joint press conference in Beijing with Chinese President Xi Jinping.

‘But we did encourage Chinese authorities to take steps to preserve the unique cultural, religious and linguistic identity of the Tibetan people,’ the U.S. leader said.

Obama has no sense of shame.  We can’t even say that he cynically sold out Tibet for profit.  We got nothing for our benefit.

Wow, Such A Deal Maker

Obozo Doubles Clean Air Promises, China Laughs, Doubles Pollution

Such a negotiator this guy is. Oy.

President Barack Obama announced Wednesday that the U.S. has set a new goal to reduce emissions of greenhouse gases by between 26 percent and 28 percent over the next 11 years as part of a climate change agreement with China.

The new target is a drastic increase from earlier in Obama’s presidency, when he pledged to cut emissions by 17 percent by 2020. By contrast, Obama’s counterpart, Xi Jinping, did not pledge any reductions by a specific date, but rather set a target for China’s emissions to peak by 2030, or earlier if possible. Xi also pledged to increase the share of energy that China will derive from sources other than fossil fuels. China’s emissions have grown in recent years due to the building of new coal plants.

“This is a major milestone in the U.S.-China relationship,” Obama told a news conference in Beijing, with Xi at his side. “It shows what’s possible when we work together on an urgent global challenge.”

The Associated Press reported that the deal was the result of months of secret discussions between U.S. and Chinese officials.

It was unclear how feasible it would be for either country to meet their goals, and Obama’s pledge was sure to confront tough opposition from ascendant Republicans in Congress.

“This unrealistic plan, that the president would dump on his successor, would ensure higher utility rates and far fewer jobs,” said incoming Senate Majority Leader Mitch McConnell, R-Ky, in a statement.

When reached for comment, Al Gore remained unhinged and detached from reality, still clinging to hopes of One World Socialism ...

Al Gore, the former vice president and a leading advocate for limiting climate change, called the announcement “a major step forward in the global effort to solve the climate crisis.” He said more will be required—“including a global agreement from all nations—but these actions demonstrate a serious commitment by the top two global polluters.”

Right. So we’ll flush our economy down the toilet, and China will now burn everything it can put a match to for the next generation. And then, maybe, perhaps, if they remember, they’ll do something about it.  No promises from China other than that things are going to get worse for a long time. And Algore thinks this is wonderful news, a major step forward.

Wow.

Somehow this puts me in mind of Obama’s other pledge to take care of his friends and to punish his enemies. Guess we know who is who, even better than before.

Dan Sullivan (R) Wins Alaska Senate Seat

Republican candidate Dan Sullivan defeated Democratic incumbent Sen. Mark Begich in Alaska’s U.S. Senate race Wednesday.

The win gives the GOP eight Senate pickups in the midterm elections. The party is also seeking a ninth seat in Louisiana’s runoff in December.

Sullivan ran a confident campaign, ignoring the debate schedule Begich established and setting his own terms.

He pledged to fight federal overreach, talked about energy independence and at seemingly every opportunity, sought to tie Begich to President Barack Obama and Senate Democratic Leader Harry Reid, who are unpopular in Alaska.

Begich complained that Sullivan offered little in the way of proposals for what he would do as senator.

Earlier Tuesday, election workers began counting absentee ballots and early indications were Sullivan maintained an 8,100 vote advantage over Begich. It proved to be true later that night.

With roots in Alaska, Sullivan recently served as the state’s natural resource commissioner. He also had spent seven years in the military [USMC] and worked in Washington as assistant secretary of state. He returned to Alaska in 2009 and was appointed attorney general by former Gov. Sarah Palin.
